The general terms and conditions of sale are concluded between:

hereinafter referred to as the customer or buyer.

§1

The present general conditions of sale aim to define the contractual relations between the seller and the customer, and the conditions applicable to any purchase made through the seller’s commercial site: www.wilsonandwinona.com , hereafter referred to as „the site“.

The customer must be at least 18 years of age and have the legal capacity or parental authorization to place an order on the site. The acquisition of a product through the site implies the full and complete acceptance by the customer of these general terms of sale. These terms and conditions shall prevail over any other general or specific terms and conditions of the customer:

The seller reserves the right to modify these general terms and conditions of sale at any time. It is, however, agreed that the conditions applicable to the customer will be those in force at the date of his/her/their order on the site.

§2

Any order for a product offered on the site expresses acceptance of the general conditions of sale.

§3

The products offered by WILSON & WINONA are those which appear on the site.
They are in vintage condition and carefully selected. The quality, sizing and materials etc. are listed in the description of the article to guarantee a rigorous representation of it. As the products offered on this site are vintage or second hand products, items may have slight imperfections due to their age. The products are described and shown with the greatest possible accuracy. Variations in color may occurs, in particular due to technical limitations of the color rendering of the technical equipment used for the photographs.

The products ordered remain the property of WILSON & WINONA until full payment has been received.

§4

The prices indicated by the seller at the time of the order are denominated in Euros including tax, according to the VAT rate in force on the day of the order. Any change in the rate will be reflected in the price of the products offered. The price invoiced to the customer is the price indicated on the order confirmation sent by e-mail by WILSON & WINONA.

WILSON & WINONA reserves the right to modify its prices at any time and without notice. The price is payable in full and in one instalment upon validation to the order. The sale becomes final after acceptance of the transaction by the secure service. Any unpaid order will result in the invoicing of a fixed fee of 30 Euros per payment incident.

§5

Payments can be carried out via PayPal, Credit Card (Master or Visa) or Klarna in full safety.

WILSON & WINONA uses Shopify’s secure payment service. The integrity of the data exchanged between the purchaser and the secure stripe platform is protected against hacking attempts. The confidential data is directly transmitted encrypted on the server, without ever passing through the services of WILSON & WINONA.
WILSON & WINONA reserves the right to cancel any order that presents a risk of fraudulent use of a bank card.

§6

The validation by the customer of his/her/their order on the site involves the acceptance of the general conditions of sale. The user will then be invited to pay the order by selected payment method. When the buyer validates the payment of the order, a summary is displayed with the transaction number which is also sent by a confirmation e-mail.

A shipping confirmation e-mail is sent to the buyer on the day of the products shipped, containing the tracking link for the package.

§7

The ordered products can be delivered to most countries of Europe, North and South America, Africa, Asia and Australia. The address must not be a post office. The shipping rate is calculated automatically and added to your order at checkout. Your order will be shipped within 5-7 days. Exceptions as well as possible delays due to e.g. stays abroad by the seller or public holidays are announced on the homepage. Delivery times are estimated and WILSON & WINONA will not take responsibility for delays caused by the courier service.

In the event of error in the wording of the recipients address, WILSON & WINONA cannot be held responsible for the impossibility of delivering the order. Any re-shipment due to erroneous delivery address or non-collection with the postal service will result in the payment of additional costs.

Delivery times are in working days and correspond to the average time of the selected courier DHL Germany or Hermes.

The products of WILSON & WINONA are in conformity with the German legislation in force. WILSON & WINONA cannot be held responsible in case of non-respect of the legislation of the country where the products are delivered. It is up to the buyer to check with the local authorities the possibilities of importing or using the products ordered.

§8

WILSON & WINONA wants to convey a sense of sustainability and appreciates the uniqueness and rarity of the pieces offered here, which is why returns are not accepted. If a flaw gets noticed while packing, the seller will hold off on shipping and contact the buyer beforehand. If the buyer receives a part with massive flaws (normal signs of wear and tear on vintage items are excluded) without the flaws being noted in the photos and description, the buyer should contact the seller within 10 days.

§9

All personal information collected within the framework of the remote sales is obligatory and necessary for the treatment and delivery of the orders e.g. for creating the invoices. This information is strictly confidential and the security protocol guarantees a total confidentiality of the transmitted information. WILSON & WINONA commits itself not to transmit or exploit any personal data of its buyers. The lack of information implies the automatic rejection of the order.

All content, which includes images, written content, audio or video posted on this website is copyright of WILSON & WINONA. Unauthorized use is prohibited. If content is exploited without permission, copyright law is violated. All elements are also under intellectual and artistic property law for the whole world.

§11

WILSON & WINONA may send commercial offers to customers by mail prior acceptance. The customer has the right to oppose the sending to commercial prospecting without charge by clicking on the link „unsubscribe“ in each mail.
